This is an English translation provided for convenience. The French version is the only legally binding text.

Article 1 – Purpose

These Terms and Conditions of Use and Sale (the “Terms”) set out how THERY-CAULIEZ Martin — sole proprietorship (the “Publisher”) makes the Carvizia website (carvizia.com) and its vehicle inspection report services available to users (the “User” or the “Customer”).

Creating an account or buying credits on Carvizia implies unreserved acceptance of these Terms.

Article 2 – Access to the Service and Account Creation

Generating reports requires a personal user account.

  • The User undertakes to provide accurate information when registering.
  • The account is strictly personal. The User is responsible for keeping their login details confidential.
  • The Publisher reserves the right to suspend or delete an account in the event of fraudulent use, abuse or breach of these Terms.

Article 3 – Prices, Credits and Payment

The Carvizia service works with virtual credits.

  • Purchase: Credits can be bought individually or in packs. The applicable prices are those shown on the website when the order is confirmed, in the currency displayed.
  • Use: Generating a report uses a set number of credits, shown before the request is confirmed.
  • Secure payment: Payment is made by card. The whole payment process and the security of card data are handled exclusively by our certified payment provider, Stripe.

Article 4 – Right of Withdrawal (Waiver)

Under article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal. By buying credits and generating a report on Carvizia, the Customer agrees that the service is performed immediately and expressly waives the 14-day withdrawal period. Credits bought and not used are not refundable.

Article 5 – Nature of the Service and Limitation of Liability

  • Best-efforts obligation: Carvizia reports are compiled from public and private databases. The Publisher uses all the means at its disposal to provide reliable, up-to-date information.
  • No absolute guarantee: The Publisher cannot guarantee that the data in the reports is complete, perfectly accurate or fully up to date (undeclared accidents, undetectable clocked mileage, etc.).
  • Decision-making aid: The Carvizia report is a decision-making aid and in no way replaces a physical inspection by an automotive professional (mechanic, approved assessor). The Publisher cannot be held liable for a bad purchase, hidden defects, or any direct or indirect, material or immaterial damage resulting from the use of the information in a report.

Article 6 – Website Availability

The Publisher strives to keep the Carvizia website available 24/7. Access may however be temporarily suspended for maintenance, updates or force majeure, without giving rise to any compensation for the User.

Article 7 – Intellectual Property

The structure of the website, the generation algorithms, the interface and the graphic elements are the exclusive property of the Publisher. Reselling, copying or mass commercial use of Carvizia reports by third-party companies without a partnership agreement is strictly prohibited.

Article 8 – Personal Data (GDPR)

How personal data is collected and processed, and the Users' rights, are described in the “Legal notice and privacy policy” page linked in the website footer.

Article 9 – Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, the User will first contact the Publisher (contact@carvizia.com) to seek an amicable solution. Failing that, the French courts of Lyon will have sole jurisdiction, without prejudice to any mandatory consumer protection rules of the User's country of residence.
